Terms of Service

These Terms of Service ("Terms") govern your use of the Catch 'Em Cord Discord bot (the "Bot", "Service"). In these Terms, "we", "us", and "our" mean Catch 'Em Cord and its operators. By adding or using the Bot, you agree to these Terms. If you do not agree, do not use the Bot.

1. Eligibility

You must meet Discord's minimum age requirement (13+, or the minimum age of digital consent in your country, whichever is higher) and comply with Discord's Terms of Service. You are responsible for following the rules of any server where you use the Bot.

2. The Service

Catch 'Em Cord is a free, fan-made game bot made for Discord, provided for entertainment. Features, mechanics, rewards, drop rates, and prices may change, be added, or be removed at any time.

3. Intellectual property & non-affiliation

Catch 'Em Cord is an unofficial, non-commercial fan project. It is not affiliated with, endorsed by, sponsored by, or associated with Nintendo, Game Freak, or The Pokémon Company. Pokémon and all related names, characters, artwork, and trademarks are the property of their respective owners and are used here in a fan-work context with no claim of ownership. We respect those rights and will respond in good faith to any valid request from the rights holders.

4. Virtual items and currency

All in-game items, currency (₽), Pokémon, and progress are virtual, exist only inside the Bot, and have no real-world or monetary value.
They are not your property. You receive a limited, personal, revocable license to use them inside the Bot only.
You may not sell, buy, transfer, or exchange virtual items, currency, Pokémon, or accounts for real money, cryptocurrency, goods, services, or items in any other game or platform ("real-money trading" or "crosstrading"). This is prohibited and may result in a ban.
You may not offer or trade in-game currency or items in exchange for joining a Discord server, following an account, voting, or any other off-platform action.
We may adjust, reset, or remove virtual items, currency, or progress (for balance, anti-abuse, bug fixes, or any reason) without compensation.
No purchase is necessary to play. The Bot is currently entirely free; see Section 8 for how any future optional paid features would work.

5. No real-money gambling

Any wagering, market, trading, or chance-based feature uses only virtual in-game currency with no cash value. It is part of the game, is not gambling, and does not involve real money or anything of real-world value.

6. Acceptable use

You agree not to: harass, abuse, threaten, or harm other users, or submit content that is illegal, hateful, sexually explicit, or otherwise violates Discord's rules; exploit bugs, glitches, duplication, or unintended mechanics for gain instead of reporting them; attempt to disrupt, overload, reverse-engineer, decompile, or gain unauthorized access to the Bot or its infrastructure; impersonate the Bot, its team, or other users, or attempt to phish or compromise accounts; or resell, sublicense, or commercially exploit the Service without our written permission. We may remove progress, suspend, or permanently ban accounts that violate these Terms, at our discretion and without prior notice.

7. Automation & prohibited software

The Service is for genuine human use only. You may not use, distribute, or assist with any automated or unauthorized software, including:

Autocatchers or scripts that detect spawns and catch on your behalf;
Autospammers that automatically post messages to trigger or farm spawns and rewards;
Autosnipers / autobidders that automatically buy or bid on the market;
Selfbots, user-bots, macros, or bots acting on your Discord account;
Multiple or alternate accounts used to gain an unfair advantage, farm rewards, evade bans, or manipulate trades, the market, or wagers.

Using any of the above may result in removal of progress and a permanent ban.

8. Purchases & payments

The Bot is currently free and offers no paid features. If we introduce optional paid features in the future:

The specific terms (including prices, applicable taxes, what you receive, and refund/cancellation terms) will be presented to you at the time of purchase and incorporated into these Terms.
Payments will be handled by a third-party payment processor (for example, Patreon or a similar provider). Your payment is also subject to that processor's terms and privacy policy, and the processor, not us, handles your payment details.
We are not responsible for errors, fees, or failures caused by the payment processor.
Any paid features will sell convenience or cosmetics only (never gameplay power or Pokémon) and will never confer a competitive advantage.

9. Availability and changes

The Bot is provided "as is" and "as available" with no guarantee of uptime, error-free operation, or preservation of your data or progress. We may modify, suspend, or discontinue the Service at any time, with or without notice, and may interrupt it for maintenance, without liability to you.

10. Disclaimer of warranties

To the fullest extent permitted by law, the Bot is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, progress, or virtual items, arising from your use of (or inability to use) the Bot. Our total aggregate liability for any claim relating to the Service will not exceed USD $100 (or, if greater, the total amount you paid us in the 12 months before the claim).

12. Indemnification

You agree to indemnify and hold harmless Catch 'Em Cord and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Bot, your violation of these Terms, or your violation of any law or the rights of a third party.

13. Termination

You may stop using the Bot at any time and request deletion of your data (see the Privacy Policy). We may suspend or terminate your access immediately, without notice, at our discretion, for any violation of these Terms or for any reason.

14. Changes to these Terms

We may update these Terms. Material changes are reflected by the "Last updated" date and announced where appropriate. Continued use means you accept the updated Terms.
